These Terms of Service ("Terms") govern your use of GmAssist ("the Service"). By using the Service, you agree to be bound by these Terms.

1. Service Description

The Service is a Chrome extension that integrates with Gmail and provides the following features:

  1. A Google account is required to use the Service.
  2. Users are responsible for managing their own accounts.
  3. The operator may suspend accounts without prior notice if unauthorized use is detected.

3. Pricing

  1. The Service offers a Free plan and a Pro plan (paid).
  2. Pro plan pricing: $1.99/month or $19.99/year (USD). Local pricing may vary by region.
  3. New users receive a 3-day free trial. After the trial, users are automatically moved to the Free plan with no charges.
  4. Pro subscriptions auto-renew. Cancellation is available anytime through the Stripe customer portal.
  5. After cancellation, Pro features remain available until the end of the current billing period.
  6. Pricing may change with prior notice.
  7. Due to the nature of the service, refunds are generally not provided after payment. However, individual cases will be considered if the service was unavailable due to significant issues.

4. Usage Limits

Limits may change based on service operational conditions.

5. Prohibited Activities

Users must not engage in the following:

  1. Reverse engineering, decompiling, or disassembling the Service
  2. Sending excessive requests through automated tools
  3. Unauthorized use of other users' accounts
  4. Illegal activities using the Service
  5. Actions that interfere with the operation of the Service
  6. Stalking or other activities that significantly violate a recipient's privacy using the open tracking feature
  7. Sending mass spam emails using the scheduled sending feature

6. AI-Generated Content Disclaimer

  1. Summaries, replies, action items, and other content generated by the Service are automatically produced by AI. Their accuracy, completeness, and appropriateness are not guaranteed.
  2. Users are responsible for the content of emails sent using AI-generated text.
  3. The operator assumes no liability for damages arising from the use of AI-generated content.
  4. Users are also responsible for the content of AI-generated emails sent using the scheduled sending feature.
  5. Open tracking results are provided for reference only and their accuracy is not guaranteed (email opens may not be detected depending on the recipient's email client settings).

7. Intellectual Property

  1. Intellectual property rights related to the Service belong to the operator.
  2. Usage rights to AI-generated content (summaries, replies, etc.) belong to the user, who may use them freely.

8. Age Restriction

This Service is intended for users aged 18 and older. Users under 18 should obtain parental consent before use.

9. Third-Party Service Dependencies

The Service is a Chrome extension that operates on Gmail and depends on third-party services including Google, Gmail, and OpenAI. The operator is not liable if the Service becomes partially or fully unavailable due to specification changes, outages, or discontinuation of these third-party services.

10. Service Changes and Termination

  1. The operator may modify, add, or remove Service features without prior notice.
  2. The operator may terminate the Service in whole or in part for unavoidable reasons. Reasonable prior notice will be given in the event of termination.

11. Limitation of Liability

  1. The operator does not guarantee the completeness, accuracy, reliability, or usefulness of the Service.
  2. The operator is not liable for service disruptions caused by factors outside its control, such as network conditions or Gmail specification changes.
  3. The operator is not liable for damages arising from use of the Service, except in cases of willful misconduct or gross negligence.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes related to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
